I filed a lien on an apartment complex we service. After they received the lien, they ended up paying. What do I do know on my end? Do I have to un-file the lien somehow or is that something they do on their end?
You have to prepare and file a release of your lien. Retain a construction attorney to help. If you do not release your lien, you could violate the Texas Fraudulent Lien Act, and could be liable for $10,000 in statutory damages, or actual damages, whichever is greater, plus attorney's fees.
