Florida Notice of Intent to Lien

Under Florida law, there is no actual requirement to send a Notice of Intent to File a Lien. However, we always recommend sending one as they are typically enough to loosen the grip on your hard-earned money before having to spend the time and money filing a lien claim. There is no specific timeframe to wait before filing your claim after sending this notice.

Florida mechanics lien deadline

That being said, a mechanics lien in Florida must be filed within 90 days after the claimant's last day of furnishing labor or materials. It's good practice to allow some time to pass after sending the Notice of Intent before actually filing your claim. That way the recipient has time to respond.

Florida Notice of Claim of Lien

One extra thing to keep in mind, if it comes down to filing the lien claim, a copy of the claim should be sent to the property owner prior to, or within 15 days of recording the lien claim, This notice should be sent by registered or certified mail with return receipt requested.
