In Louisiana liens on private projects must generally be filed within 60 days from the substantial completion of the entire work. However, if the owner or prime contractor files a notice of substantial completion, the period is shortened to 30 days after that filing. On public projects, a claim against the project's bond must be filed within 45 days of the completion of the project. Airport projects can be confusing with respect to whether the project is public or private. In many cases, projects in airports are tenant improvements in which the contracting party is a vendor of some sort building out a space inside the airport itself. While the land an airport sits on can be publicly owned, and therefore un-lienable, the contracting parties may all be private entities. In any event, if there are payment bond protections in place, it is always a good idea to attempt to comply with the timing and deadline provisions of the bond itself. Requesting a copy of the bond and providing notice of a claim within the deadline set forth on the bond document usually puts a claimant in the best position to recover.
