After paying contractor he took my money and ran...I filed on his bond and they told me since he did not start digging I was not able to collect...how does the bond protect consumers from fraud??

I'm sorry to hear about that. If a contractor is actually licensed and bonded, an owner should be able to hold the contractor accountable via legal action - even if the contractor's bonding company refuses a claim against the bond. If a contractor has acted fraudulently or breached their contract, then fraud claims, breach of contract claims, and other legal claims could be on the table.
Further, making a consumer complaint with the North Dakota attorney general's office could be valuable, too. The attorney general is generally responsible for protecting North Dakota consumers from fraud.
Unfortunately, I'm not well versed in recovering payment from fraudulent North Dakota contractors. However, reaching out to a local North Dakota attorney should be helpful for providing clarity in how best to proceed with potential claims.
