How do I remove a lien?

I have been payed in full, I want to remove a lien that I have on the house.

Getting paid is the ultimate goal of anybody filing a lien, but after payment is made, the lien has served its purpose and must be released so that it no longer appears to encumber the property.

In Colorado, once the lien claimant’s claim has been satisfied the claimant is responsible for filing an acknowledgement of satisfaction within 10 days of a written request to do so. Failure to filing the satisfaction document will subject the lien claimant to penalties of $10 per day for every day the acknowledgement of satisfaction remains unfiled.

A satisfaction and cancellation of mechanics lien can be filed easily electronically through the use of software, here. Or, the lien claimant can enlist an attorney or manually fill out a release of lien form and send it to the proper county for filing.

Under Colorado mechanics lien law, the removal of a mechanics lien is governed by C.R.S. §38-22-118. This states that when the debt has been satisfied, the lien claimant should file a lien release (also known as an "acknowledgment of satisfaction") in the same county clerk and recorder's office where the lien was filed. Although not technically required to do so until requested by the owner, it's best business practice to release the claim once you've been paid. However, if you do receive a written request to remove the lien from the property owner, you'll have 10 days to do so. Failure to remove the claim within that time period can make you liable for a $10-per-day penalty until the lien is removed.
