We are a Sub-Contractor based out of NJ who worked on a commercial project in Virginia. The date of completion and our invoice date are 01/272022. We did not send out a notice of furnishings (did not know procedure). The General contractor is refusing to pay us.
No. First, you were required to file a memorandum of mechanic's lien within 90 days of the last day of the month that you worked. The deadline for filing was May 2nd (pushes to next business day when 90th day falls on a weekend). Second, if you were performing construction work and were not a properly licensed in Virginia, you don't have lien rights.
