So I’m in Texas I didn’t really know about Leon’s never had to do in 10 years on business but if I didn’t send a preliminary Lein notice how would I go about enforcing payment.. or do I chalk it up as a loss and learning experience moving forward

There are many unanswered issues in your question.
It will matter if this is a residential or commercial project. A constitutional lien might be an option.
If it is a commercial project, there might be ways to pressure the contractor by informing the owner that the contractor has failed to make payment.
Depending on the materials installed, some may be "removables".

I agree with Dewey that there's a lot to be determined here. In short, you may still have options but you need to reach out to an attorney as soon as possible.
