Handyman warranty

VirginiaDefects

I hired a handyman who fixed drywall after a flood now the fixed drywall has a crack should the Handiman fix it again for no charge. He did not give me any warranty I just paid him by the hr for work he did. Is there any implied warranted.

Even when no express warranty has been given by a contractor, there are often implied warranties that must be kept in mind. Levelset discusses those, generally, here: An Implied Good Workmanship Warranty Exists for ALL Construction Work. Looking to Tennessee, specifically: It appears that Tennessee courts have held that an implied workmanship warranty exists in the event that there's no express warranty for the work that's being performed. And, as a result, failure to do work in a workmanlike manner - and failure to repair defective work - may result in a breach of contract. Pepper Law, PLC has an excellent article on the topic: Home Construction Contract Case: Tennessee Court Of Appeals Upholds Nashville Chancery Court.

You should contact him again and ask him to fulfill his obligations. This is an unacceptable action.

You should have raised warranty issues from the very beginning of your contract with him. Usually doing so the workers will be much more careful than the Vampire Survivors
