Do you file the lawsuit paperwork for liens coming up on the 9O period after the lien has been filed?

We completed two contracts for the same GC. We filed liens on both. One is at either the extention or file suit point. The GC is still negoiating with us, but I may proceed filing the papers, perfecting the lien as an incentive. Can you tell me what your charge would be to file such paper work?

You need a lawyer to prepare the lawsuit. Any construction law attorney can assist you. Make sure the lawsuit is filed prior to the experation of the 90 days, or your lawsuit will be worthless. Expect your attorney to need some time to review the file and prepare the lawsuit before it is filed.

Hi,

Yes, we handle litigation of liens. It’s hard to give an exact quote, but it’s usually about 5 hours to review your subcontract, billings, lien and file the suit. Our hourly rate is $400. The filing fee is $500.

Are you in SF Bay Area? If not, you should get a lawyer in your area to handle it.
