Do I have to wait until the MDOT project is complete and signed off on before I file a suit against the claim?

We have a bond claim filed with the General Contractor of the project. The GC is not our customer, our customer sold to the GC. Our customer is not paying for the material sold.

In Michigan, like many states, a claimant can file a bond claim and file a suit for the enforcement of that claim prior to project completion. On highway projects, the deadline to file is 1 year form the completion and final acceptance, but there is not a restriction forcing a claimant to wait until after completion to file. On non-highway projects, a claimant must wait until 90 days after the date on which labor/materials were last supply, and the deadline is 1 year from the date on which final payment was made to the prime contractor.
