Do I have the right to file an Mechanic's Lien?

I was a sub-consultant that provided engineering services for a project in Oklahoma. The prime consultant was paid in full and the project was built but they have not paid my fee. Using Levelset, I filed an mechanic's lien on the property to reclaim my fee. The attorney for the land owner, just called me to tell me I did have right to file a lien because I wasn't a direct relationship with the owner. Is this correct?

While making several assumptions about the project and your situation, you DID have the right to file a lien (assuming it was timely, documented correctly, filed in accordance with OK law and procedures, etc.), generally speaking. Your firm's right to file a lien is not contingent upon your firm's contractual relationship with the Owner.

Generally, a design professional has a right to file a lien when the design work is actually incorporated into improvements on the property. A direct relationship between the design professional and owner is usually not required. Your particular situation may depend on the services you provided and yourrelationship with the prime contractor. You should contact an attorney. You might have claims for recovery beyond a lien.
