As your office has assisted in filing the notice of lien on the above matter, we have some questions on the process as we are presently involved in litigation with the other party CDC. As such, we would like to discuss this matter with one of your attorneys if at all possible. We were sued by the our client and we filed the lien notice
against the client, and we answered the lawsuit. In doing so, we made a counter claim breach of contract against the client that was identified in the lien. We did not however file an action to enforce the lien, as our attorney does not specialize in liens. However, that said, our attorney's research suggests that we may need to file as part of our counter claim, a claim to enforce the lien. Our response can be amended but need to do so by Monday.
So we have the following questions:
1. Do we need to file as part of an existing lawsuit a claim to enforce the lien?
2. The other question is...
should interest be included in the lien and the enforcement proceeding?
If interest cannot be included, but CAD has additional services that
were not included how do we handle/correct etc?
3. Our company has litigation already going and we are represented by
counsel, but that our counsel would like to discuss matters with you and
may seek some assistance, if you could provide a contact to discuss the
above items.
