i have a written contract started a year ago, with a trustee of a house in indiana to do some work. he paid me so much down and balance due upon completion. ive completed job this week and he is refusing payment of the ballance. did i need to file a preliminary notice last year for my claim to be valid now.
Give my office a call so I can get some more information regarding your case. Typically, if you are a sub you would have needed to give notice within 30 days of first furnishing work/materials. If you are the general then you have 60 days from last day of work. There are a number of other stautes that apply to home improvements in Indiana such as the Home Improvement Contract Act. There may be some strategy that goes into when you file given the exposure you could have from the statutes I referenced--the HICA in particular.
