Can we add he pre-lien notice on the contract weather its for a general contractor or a residential owner?

CaliforniaLien Releases

Hello, my husband and I have our own small construction business (C-8 Concrete). After doing a small concrete installation for a contractor for an apartment complex here in California Hayward, we have not gotten paid since October 2019. Because of this particular incident that has not been resolved, I have been educating my self on the pre-liens. I wanted to know If we can include the pre-lien notice on the contract in the future with general contractors and residential home owners that hired us or do we have to mail them to them? Thanks, Zaazil

You must follow the procedure in the Civil Code for serving notice. Personal service, registered mail or certified mail are the only valid methods of service. Certified mail is preferred, because it provides proof of proper service. By placing the prelien in your contract, inevitably you will exchange documents via email and improperly serve your notice. Therefore, I recommend that you not utilize this method and instead create a reliable procedure of utilizing certified mail.
