Can I take legal action against contractor?

New York

We signed a contract for a home remodel that was supposed to be completed within 90 days. Today is day 134 and we have no end date in sight. Our contractor rarely answers phone calls or text messages at this point, we have no idea when people are actually coming to work (we were told 3 weeks ago someone would be there at 10 am - still waiting; workers randomly show up on Saturday or Sundays at all hours with no notice), and most of the work that has been complete is not what we wanted. There are multiple issues I was told we have to "deal with" because they should have been corrected months ago, but the contractor was never here to actually check on his sub-contractor's work. And now when he does answer us it's just to say he cannot get his sub-contractor's to respond to him or come and work. As I see it he entered into a contract with us and took our money (almost all of it at this point) and has been unable to deliver on what we agreed upon. He is not communicating, we have spent a significant amount out of pocket we never planned on, and we have no idea when this will be complete, and if it will be correct. Is getting a lawyer involved worth it? Do I have a legal leg to stand on at this point?

Yes -- it is worth getting an attorney involved and I’d be happy to have a brief conversation to obtain further information.
