Can I send a notice to lien against the homeowner's association and the homeowner at the same time?

we have several projects that we worked on in an apartment building. All units are independently owned. We have work authorizations signed by the owners. We were told the HOA insurance will pay for this. We have not received any payments yet. We want to send a preliminary notice of intent to lien the homeowner and the HOA at the same time. Can we add both to the same notice?

Yes, you can send the notice of intent to place a lien to both homeowners and the HOA.

The HOA is usually an independent entity like an LLC or corporation. If the HOA signed a document or somehow authorized or requested your services, then yes they are a party and can be liened. Otherwise, your lien rights are against the individual units and you should apportion each units amount in each lien.
