I own a Janitorial business in Virginia. I have a client that I have a contract for cleaning their office complex 5x a week for three years now . And I supply Toilet paper, hand towels and soap on a reimbursement agreement. They are currently 90 days behind. Blaming it on the USPS. Id like to recover my Money before I give notice to quit. That is a great question. It is important to keep in mind that a mechanics lien is filed if a party has provided labor or materials that then creates an improvement to a property. In Virginia specifically, parties, "who furnishes labor or materials for the construction, removal, repair, or improvement of any building or structure permanently annexed to land is entitled to mechanics lien protection (provided the value was $150 or more)." Suppliers to suppliers may also be entitled to mechanics lien rights. Considering you provide cleaning like materials and not building materials that are used in compliance of construction work, I am not confident that you are one of the qualifying parties included that may file a mechanics lien.
