TexasMechanics LienPreliminary Notice

Hi! It is time to file a lien and the notices were sent to the previous owner and not the current. Can the lien still be filed with the current owner's information?

The inception of a mechanic's lien dates back to the start of the construction. So, if the former owner owned the property then, the current owner would have acquired the property subject to the mechanic's lien.

You should notifiy both if you file a mechanic's lien (or if you have to issue any more notices of non-payment and funds trapping requests).

Retain a construction attorney to evaluate your situtation and to provide advice.

Good luck.
