I am a material supplier hired by the installer. The installer has been saying that they will pay for the last 639 days. I want to know what we can do to get payment for this as it's #30
In New York, on a single family home a supplier has four months from the date on which it provided its last materials to the project to assert the lien. On a non single family home, that time is eight months. If you last provided materials to the project 639 days ago, then unfortunately you are well beyond that time.
From the facts provided, it appears it is too late for you file a lien, unless this is an on going public works project. Then it may still be possible.
At this point, your best option may be to retain counsel and commence litigation.
