Can I file a mechanics lien?

Illinois

I’m a contractor who finished a job about 4 months ago and have been waiting for payment. The client initially asked if he could pay in payments and we agreed on the terms. Clearly a long time has passed and he has stopped answering calls and messages. The property is a restaurant opening soon. What can I do?

You can file a lien but if at all possible do it within 4 months of you last day of work. You can also file suit for breach of contract or other quasi contract claims.

Filing a mechanics lien may be your best option at this point. Depending on the size of the lien and the complexity of the case, it may be worth speaking to a lawyer about how best to proceed.

 The issues you are dealing with depend on a careful review of
the contract and other writings which are part of the transaction. The moral of
your story is that a lawyer should be hired at the beginning of the transaction
to revise and draft the contract.
