Can I file a Mechanic's Lien

WashingtonConstruction ContractMechanics LienPreliminary NoticeRight to Lien

I have a building permit service. I applied for the building permit for a client and paid all of the fees. The client is a retailer/tenant and the location of the project is in a shopping mall in Lynwood, WA. I am not getting paid for the work I performed and fees I paid. The amount that is owed is $4,243,64. I did not file any notices. Can I file a lien on the property.

Typically in Washington, if you don't file a proper prelim notice, you can't file a mechanics lien for non-payment. Here are the Washington prelim requirements. However, the amount you are owed ($4243.64 - I am guessing that comma should have been a decimal point) looks like you could pursue collection action via small claims court. This looks like a pretty simple breach of contract issue. Provide a copy of the contract, and show proof that you did the work, then he has to explain why he hasn't paid you yet. That being said, I AM NOT an attorney or attempting to provide legal advice. My response is based on personal life experiences and basic common sense.
