Can I file a lien on a company if I paid a deposit to have work performed?

I paid a 50% deposit for work to be done on March 29, 2021. The contractor said ihe placed the order for material fabrication on Thursday March 25, 2021 and said he would call once the materials were delivered to him to set up installation. He said that it would take 2 weeks to get the material After the 2 weeks he kept making excuses about the material not coming in. The last email I received from him on May 17, 2021 said that he was not in the country because his Mom passed away and that he would call to take of the work. It has been 10 weeks since I made the deposit and I have not heard from him since despite making daily phone calls and sending daily emails inquiring about the install date.
