Customer was on a monthly prepaid service for porta potty under personal name(not a contractor ) for property not under their name. Bills were paid for 8 months and then we had a computer error and were not getting pre monthly payment for 7 months . Porta potty was serviced . Do we have lien rights?
You can only lien for permanent improvements to real property. A porto potty is not a permanent improvement, so no.
However, Florida Statutes, Section 713.01(14) may allow for a porta potty lien when it states at the end "in equipping any improvement with fixtures or permanent apparatus or provide any solid-waste collection or disposal on the site of the improvement."
