I just paved a driveway for $14,500 Before starting I gave them them a price for the square footage, which came to the number above. He agreed and we did it, then he came and said I thought you said $1,500. That is not what I said and he knows it. Do I have a leg to stand on without a written contract for a lein?
If the work is done and you failed to serve the preliminary notice, you cannot file a lien. You can certainly sue. Please, pay an attorney for a few hours of their time to provide you a solid contract and lien forms and then never do work without a signed contract and always timely file a preliminary notice.
