A mechanic's lien in New York can be filed by anyone that provides labor or materials for the permanent improvement of real property. Design services create a grey area as to whether they were services related to the permanent improvement of the property. In general, whether an "interior designer" can file a mechanic's lien would require a very specific fact-intensive inquiry as to the nature of the services. However, most courts that have examined these services have determined that the interior design does not qualify as a permanent improvement and, therefore, that the services are not lienable.
