Can a solar company put a lien on my property with no work being done just for a cancellation clause.

TexasMechanics Lien

A solar company is threatening to put a lien on my property for early termination of my project. No work was performed on my property. I did not let them install for multiple reasons. What rights do I have as a homeowner to protect me from this.

Mechanic's liens are for unpaid work. So if no work was done then the lien would likely be unenforceable.

What's the process of them putting the lien on my property ? How do I fight that or who can I contact regarding protecting my rights as a Texas resident?

Hello all, The first comment is correct, a lien is for unpaid work. I would add that you may want to check the contract for what they may consider work. If they mobilized or spent money ordering materials for your job, this may constitute work that would entitle them to a lien. As a homeowner, you have several options to remove liens. 1. Ask the company to remove the lien. 2. Find an attorney to send a letter demanding removal of the lien. 3. File a suit to have an invalid or unenforceable lien removed under Chapter 53 of the Texas Property Code. Chapter 53 of the Property Code is very fairly clear on how a contractor can go about perfecting a lien. Since they would be the General Contractor in this instance, they would not have to provide notice prior to filing the lien but they will have to send you notice via Certified Mail within 5 days of filing the affidavit claiming lien. Thank you for sharing this with us. It's even strange because I have worked with so many solar panel and battery companies and have never come across anything like this. Most often, of course, I turn to https://a1solarstore.com/solar-panels/arizona.html , thanks to which I now have not only panels installed at work, but also at home and at the cottage. I consider it a good investment for the future.
