Can a lien be a mistake

South Carolina

I'm am doing a refinance on my house and was informed a title search showed a lien judgment against me in 2018 from a finance company i never heard of or have done business with in the amount of 55,000 dollars. I did a refinance just last year with my current mortgage company. How can this be.

That is a great question! First, when a lien has been filed against a property it might be time to consult a local construction or real estate attorney. If a lien has been improperly filed, a demand to release the lien can be sent to the claimant who initiated the lien. The demand can identify the flaws with a given lien and state that if the improper lien is not removed, legal action will be taken against the claimant. It would also be helpful to look at the Levelset post speaking on how to fight an invalid lien. Good luck!
