Bonding and suggestions for receivables

MassachusettsBond Claims

I am on a private job in ma for subcontract work that I was not paid for 220k of work completed. The total project worth is 20M. I was informed there is no bonding on the job. This is NOT public or state work. One would think that the laws would require the construction company to have bonding but I have been reading that only public jobs require this over 25 K. I know procedures are mediation and arbitration but is there anything else I can do besides liens? Thankyou

If the job is truly private, you need to record a mechanic's lien ASAP.  A subcontractor can only collect against an owner to the extent that money is due or to become due to the GC.  The longer you wait, the less likely that money will be owed.  If you haven't been paid, it sounds like the GC may be in trouble. In addition, the job would be covered by the Prompt Pay Statute.  Feel free to give me a call and we can discuss this further. P.S.  I do need to know who the parties are, because I may have a conflict.
Sincerely,

 Andrea
