Making a bond claim is like throwing a football in that "anyone" can do it, but what makes the difference in the outcome are the performance nuances of preparation, attention to detail, properly documenting the claim, persuasively integrating facts and the law, and skillfully negotiating to optimize net recovery. There are some technical matters that have to be put into place before you can pursue a claim against the bond. One may be the service of a Notice of Nonpayment to the GC and the insurance company. It depends on the type of bond the GC has for the project. Like a construction lien your claim against the bond is time limited so it is better to pursue it earlier than later.
