As a general contractor, could a statement about the right to lien in the contract itself serve as a preliminary notice to right to lien?

WyomingPreliminary Notice

Just a general question to streamline the process if possible

This is a great question and one we’ve seen plenty of times before. Our CLO Nate Budde actually wrote a whole article on this exact topic: Can I Include My Preliminary Notice in My Contract? Even using the same language as you have, “including a notice in your contract doesn’t actually help solve any issues or streamline the process.” So the short answer is no. The Wyoming lien statutes not only have specific statutory form and language requirements, (substantially the same format and contain the same information) but also specific delivery methods (certified mail with return receipt requested.)
