Arbitration Extension

Long story short, like many construction firms, my firm has found itself participating in another arbitration case. We are representing ourselves pro se. The owner of my firm has been out, and hospitalized, due to serious medical issues. I am participating, but has no executive agency to make decisions. Because of the above stipulated issues, we have requested an extension of the process. This would be are 2nd extension, again due to the above. However, counsel for the opposing party (the claimant) has not concurred with this extension. I know that we need to get our lawyer involved, but in the interim, what are our options? Because of the extenuating circumstances what can be done on our end to extend this process? Thank you!

You should clearly inform the arbitrator of these issues and request an extension of time. It sounds like you have already done this. 

Decisions in an arbitration case are made by the arbitrator alone. Getting your attorney involved now may help in achieving an extension of time. However, there may be time constraints for the arbitration which require the arbitration to go forward and which your attorney will not be able to overcome. 

If your request for an extension of time is not granted by the arbitrator, the best path forward is to appropriately prepare for arbitration and ultimately win the arbitration on the merits.

There are some threshold questions that need to be answered. Is your arbitration a private arbitration or in the Court's arbitration program. The rules are different depending on the venue. I suggest you ask for the time regardless of the other side's position so you can preserve it for appeal. The reason for this continuance seems reasonable; so a denial of it should be noted so it can be challenged later if necessary.
