Amend

California

Hello! I have a project we lien’d and was sent to get recorded on 3/17. Unfortunately, Orange County closed their offices due to the corona-virus. We lien’d two change orders and 50% of the retention. We thought we would get paid fast since we lien’d but that’s not the case now since they are closed. We have until 4/15 to lien the remainder of the retention since occupancy will be within the 90 days. I was told to Amend the current Lien but was told they couldn’t because they need information from that Lien once its recorded and then they can Amend. The County office could be closed until the end of April and I need to amend or submit a 2nd Lien by 4/15 or I will lose my Lien rights. What should I do now? Wait to Amend since they need info but I have the chance of losing my Lien rights or submit an additional Lien? Can you have two Lien's for the same contract?

That's a tough one, but I would record another lien, if you are not able to amend your present lien. So, long as neither of the liens are overstated, you should be fine.

You may want to release the prior lien to record a larger lien.

In our counties in Northern California the Recorder's Offices are closed to the public but you can still mail things in to them and get them recorded. Check to see if that's what happening in your county. If the first lien hasn't been recorded yet you can just mail in a new lien for the new amount without calling it an Amended Lien.

Amend is a legal term that means to change something in writing. For example, if you want to change your will, you would amend fnaf pokedle your will to add or remove an heir. If you want to sell your house, you would amend the deed to include new owners.

Did you manage to solve that problem? I can tell you that I have a similar issue, and I've never had to deal with so many documents in my life. I even have to use https://www.securedocsharing.com/ to make sure that my data won't get leaked, and I hope that I'll manage to figure everything out eventually.
