A contractor(nick) hired me to do a deck and sand and stain all deck on the house and after 90% of the job done descide to fired me because he is a crook so he is hired 2 guys to finish it and the the reason for not paying me is i did not finish the job i have 127 hours an he did nt pay me 1hours on top of that he call the police i had to leave the customer txt me please come back i came back but after and argument because he not even want to pay the materal i put from my pocket ....after i left i see this Nick passing on the street with all my tool from the site he took it so i cant work and multiple time he told me that he is not paying.
If you're in New York, you have four months to lien the property if it is resedential and eight months if it is commerical. You would have lien rights in this instance, but you'd need to supply proof of the work you performed eventually. Either way, if you did the work, you can lien. Good luck!
This general contractor is not a good person. I recommend that you reach out to both the New York State Department of Labor and the New York City Office of Human Rights and file claims for unpaid wages. There are statutes prohibiting wage theft in NY and they should protect you. Best of luck!
