In South Dakota we hired and paid a man $3000 in full to cut down a tree in our back yard. The price included rental of a lift. The man abandoned our job unfinished and failed to pay the rental company for the lift. The rental company is threatening to file a lien against our property for the cost of renting the equipment and the cost to repair damage they claim was caused to the lift. 2 Questions: 1) Per S.D. S.D. Codified Laws Section 44-9-1(1) are they entitled to a lien for cutting down a tree? 2) Are they allowed to include the cost to repair equipment They claim was damaged?
