Sunday June 18th was the 90th day to serve a notice of nonpayment. You might be able to win an argument that the 90th day rolls to today, June 19th, but you better serve either a notice of nonpayment or file a lien today. To be clear, this is not legal advise. Make sure there is a properly filed notice of commencmenet, which is technically the onwer’s job but the GC usually fills out and has the owner sign. Tehcnically you don’t need a notice to owner if you are truly in privity with the true owner of the real estate, but you better check the title on line and make sure the owner on the contract is the same person or entity that signed the contract.See More...
