The construction or mechanics lien, known in Kansas as a Claim of Lien, is filed on private construction jobs. Construction liens are available to parties who have performed labor or provided materials to a jobsite, and have not been paid. When preparing your Kansas mechanics lien form it is important to pay special attention to the description of materials and/or labor performed. The description here must be very detailed, and in fact, the courts have held that the descriptions must be “itemized.” If possible, include a copy of the outstanding itemized invoices with the lien filing. Further, serving a Kansas mechanics lien is a bit unusual as the claimant must send a copy of the mechanics lien to the property owner by restricted delivery mail. Other parties (other than the owner) may receive the mechanics lien claim by ordinary certified mail. Finally, a Kansas Mechanics Lien Must be filed with Clerk of the District Court of the county in which the property is located.

Rules and regulations for sending a Kansas Mechanics Lien
Those who do not contract with the property owner have three months from last furnishing labor and/or materials to the project to file a mechanics lien. Work must be part of the work necessary to be performed under the terms of the original contract to complete the job to qualify as extending the lien period. This deadline marks the end of the three month period when labor and/or materials were last furnished.
After completing the Kansas Mechanics Lien Form, you must deliver it to the appropriate parties required by statute. Notices are typically served on the property owner and, for sub-tier parties, the general contractor. However, depending on the type of notice, it can be helpful to send notices to anyone else who is in charge of your payment, like a lender or surety company on the project.
