Those who provide labor and/or materials to a construction project may be entitled to file a mechanics lien against the property if unpaid. In Illinois, the form that must be used to file a mechanics lien depends on whether the claimant contracted directly with the property owner. This form can be used by parties who contracted directly with the property owner. These parties are referred to as the “general contractor” or “direct contractor.” Note that while a trade contractor (i.e., plumber/electrician) may not be considered a direct, general, or prime contractor if they contract directly with the owner, this is the form that they would use.

Rules and regulations for sending a Illinois Mechanics Lien
You are allowed to file a lien up to 2 years from the date of last furnishing labor and/or materials. However, to receive ultimate protection (i.e. to file against parties who purchase the property from the original owner, lenders, etc.), a lien must be filed within 4 months from the last furnishing of labor and/or materials. This deadline marks the end of the 4 month period.
After completing the Illinois General Contractor’s Mechanics Lien Form, you must deliver it to the appropriate parties required by statute. Notices are typically served on the property owner and, for sub-tier parties, the general contractor. However, depending on the type of notice, it can be helpful to send notices to anyone else who is in charge of your payment, like a lender or surety company on the project.

A custom-window supplier is considered a "materialman" under the Illinois Mechanics Lien Act (the "Act") and therefore has full lien rights. How you enforce those rights depends on whether you contracted directly with the owner of the project (in which case you are treated as a GC) or with another contractor (in which case you are treated as a subcontractor).
To perfect your lien rights, you must observe these dates:
4-Month Notice: If you contracted with the Owner of the project, you must file your lien claim with the County Recorder and give the Owner, the Bank, and all other subs notice within 4 months of the date on which you produced the windows.
90-Day Notice: If you contracted with another contractor (i.e. the GC) you must file your claim with the Recorder and provide the Owner with notice within 90 days.
In either case, your Mechanics Lien must be in writing and include specific information, such as the amount of the claim, the date on which the work was performed, and the name of the person or entity for whom the work was performed.
2-Year Deadline: Once notice of the claim is given you must file and enforce your Mechanics Lien within 2 years of the last day of work. Failure to enforce your claim within that period renders it void.
To perfect your lien rights, you must have a valid contract with the person or entity for whom you are providing the custom windows.
